Playsum Daily Game Giveaway: Terms and Conditions

This prize giveaway (the “Promotion”) is administered by Playsum Inc. (“Playsum” or the “Promoter”), a US company and in compliance with US laws; by entering you are agreeing to the following terms and conditions (“Terms”), the Playsum Terms of Service and Playsum’s Privacy Policy.  

1. Eligibility:

The Playsum Daily Game Giveaway (the “Promotion”) is only open to those who have an active Playsum account and are 13 years of age or older. The Promotion is open worldwide, and is void where prohibited by law. Employees, independent contractors, interns, officers, directors, and agents of Playsum (the "Promoter") their respective subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Promotion. The Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited.

Any entrant who is not eligible for the Promotion can be disqualified at the Promoter’s discretion.  If proof of age is requested, and if satisfactory proof of age is not received, the Promoter reserves the right to choose another winner.

2. Promotion Period:

The Promotion begins on August the 24th, 2023 at 11:59 PM EDT and will end on September the 26th, 2023 at 11:59 PM EDT unless otherwise stated by the Promoter (the "Promotion Period"). Entries submitted before or after the Promotion Period will not be eligible for consideration.

3. How to Enter:

To enter the Promotion, participants must:

(i) Be a registered member of the Playsum app.

(ii) Launch the Playsum app.

(iii) Each day of engagement on the Playsum app within the Promotion Period counts as an entry.

Any entry, that does not comply with the requirements specified in the Promotion Message and these Terms, may be deemed invalid at the sole discretion of Playsum. 

4. Prize(s):

The winner(s) of the Promotion will receive the following prizes:

• 1 Steam game key for a random video game.

Actual/appraised value of prizes may differ at time of prize award. The specifics of the prize shall be solely determined by the Promoter. 

No cash or other prize substitution shall be permitted except for at the Promoter’s discretion. The prize is non-transferable. Substitution of the prize or transfer/assignment of the prize to others or request for the cash equivalent of the prize by the Winner is not permitted. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the Winner.

Winners shall be randomly selected from all eligible entrants during the Promotion Period, as specified in the Promotion Message. The number of winners who will be eligible to receive the Prize(s) shall be specified in the Promotion Message. The odds of winning depend upon the number of eligible entries received for any given Promotion.

Potential winners will be announced and contacted within five (5) business days of the selection by e-mail to confirm prize acceptance and determine a mailing address for the prize (if applicable). Potential winners will have five (5) business days to respond to the prize notification e-mail with the requested information. Failure to respond within this time frame will result in disqualification and the selection of an alternate winner at Playsum’s sole discretion. Return of prize notification e-mail as undeliverable will result in disqualification and the selection of an alternate winner. All decisions are final.

The Promoter may state the time of the prize draw and the time for the announcement of the winners in the Promotion Message. This is an indication of approximate times only and the Promoter shall not be liable if the prize draw and/or announcement of the winners is delayed. 

5. Publicity:

By participating in the Promotion, winners grant Playsum Inc. the right to use their Playsum usernames, images, and submitted content for promotional and advertising purposes without additional compensation or permission.

6. General Conditions:

The Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion should virus, bug, non-authorized human intervention, fraud, or other cause beyond the Promoter’s control corrupt or affect the administration, security, fairness, or proper conduct of the Promotion. In such cases, the Promoter may select a winner(s) from eligible entries received before and/or after the action taken by the Promoter if appropriate. The Promoter reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Promotion or website or violates these Terms & Conditions. The Promoter has the right, in its sole discretion, to maintain the integrity of the Promotion, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by Promotion rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Promotion may be a violation of criminal and civil laws. Should such an attempt be made, the Promoter reserves the right to seek damages to the fullest extent permitted by law.

7. Limitation of Liability:

By entering the Promotion you agree to release and hold harmless Playsum and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorised human intervention in any part of the Promotion; (iii) electronic or human error in the administration of the Promotion or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

8. Disputes: 

This Promotion is governed by the laws of United States, without respect to conflict of law doctrines. By participating in this Promotion, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in United States having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees. You further waive all rights to have damages multiplied or increased.

To request a copy of the winners list please contact the Promoter. Requests must be sent within four (4) weeks of the end of the Entry Period.

11. Data Protection:

In order to participate in the competition, participants may need to provide certain information on themselves, such as the participant’s name, email address, social handle, and country of origin. Your entry may also contain certain personal data. Winners of the Promotion may be required to provide their full address for the purpose of Playsum delivering any applicable Prize(s) (together, “Personal Data”).   

This Personal Data is collected and processed only for the purposes of organizing, running, and monitoring the Promotion, as well as for carrying out publicity activities relating to the Promotion and Playsum promotions in general. By entering this Promotion, participants agree that they have read and understood Playsum’s Privacy Policy (https://www.playsum.live/privacy), and any privacy policy that applies for any other third party whose services are used for the purposes of the Promotion (for which Playsum is not responsible) and agree to be bound by any other requirements set out in the Promotion Message, which may be amended or varied at any time by the Promoter.
